How long do you have to respond to a motion in NJ? ›

Time for Filing Most Motions

Most motions must be filed and served at least 16 days before the return date, opposition must be filed and served at least 8 days before the return date, and any reply must be filed and served at least 4 days before the return date.

Rule 1:6-2 - Form of Motion; Hearing (a)Generally. An application to the court for an order shall be by motion, or in special cases, by order to show cause. A motion, other than one made during a trial or hearing, shall be by notice of motion in writing unless the court permits it to be made orally.

The motion day does not set oral argument, unless otherwise directed by the Court, motions will be decided on the papers and no appearances are required. Note, this is the general protocol regarding motions and does not supersede any orders from the Court ruling otherwise in a case.

If a motion is filed against you and you do not file a written opposition with the court, the judge could grant the other side's motion automatically. That means the other side could get whatever she is asking for in the motion. It also might mean you lose the case, depending on the motion that was filed.

The response may agree with or oppose the action requested. If the response opposes the action requested, it must contain the reasons for opposing the motion and must include supporting evidence. The Court will enter an order in which the judge either grants or denies the motion.

Unless you have received a motion for summary judgment, you MUST respond to the moving papers at least eight days before the return date listed on the Notice of Motion. A summary judgment motion requires that the response be filed at least ten days before the return date.

While a motion to dismiss focuses on allegations, a motion for summary judgment is all about evidence. While a motion for summary judgment can be filed earlier, most often it is filed after the conclusion of discovery (when the parties produce and exchange documents, take depositions, and develop other evidence).

A party opposing a summary judgment motion must, within 28 days after the movant serves the motion, file and serve a response brief and any evidence (that is not already in the record) that the party relies on to oppose the motion.

How do I oppose a motion in NJ? ›

All parties opposing the motion shall file their opposition papers at least 14 days prior to the new motion day, and the moving party shall file its reply papers, if any, at least seven calendar days prior to the new motion day. No other extension of the time limits provided in L. Civ.
